TERMS AND CONDITIONS

These Terms and Conditions (the "Terms") govern the use of www.playthings.au (the "Site") and the subscription services provided by Playthings Pty Ltd ("Playthings", "we", "us", or "our").

By using this Site or subscribing to our service, you indicate that you have read, understood, and agree to abide by these Terms at all times.

1. Services & Subscription Model

Playthings provides a recurring toy rental and rotation subscription service. We deliver curated sets of toys in reusable containers directly to your residential address and exchange them at scheduled monthly intervals using our in-house delivery drivers.

2. Subscriptions & Billing

  • Automatic Renewal: All subscriptions automatically renew on a recurring monthly basis until you cancel. You authorise us to charge your nominated payment method on each monthly billing date.

  • Cancellation: You may cancel your subscription at any time via your online account portal on the Site. To prevent being billed for the subsequent month, cancellations must be requested at least 48 hours prior to your next scheduled billing date.

  • Pricing & Modifications: Subscription rates are displayed on our Site. We reserve the right to modify subscription pricing by providing you with at least 30 days’ written notice via email.

3. Delivery, Swaps & Property Access

Deliveries and toy box swaps are fulfilled directly by Playthings employees and in-house drivers.

  • Delivery Access: You must provide safe and clear access to your front door or designated drop-off area. Drivers reserve the right to skip a delivery if access is obstructed, unsafe, or prevented by an unrestrained pet.

  • Authority to Leave (ATL): If you are not home during a delivery window, you authorise our driver to leave the toy container in a safe spot at your designated delivery address. Playthings is not liable for theft or weather damage once the container has been delivered to your premises under ATL.

  • Proof of Delivery: Our drivers may take a timestamped photograph of the delivered container at your door as proof of fulfillment.

  • Toy Swap Obligations: On your scheduled swap day, you must pack all returning toys cleanly back into their Playthings container and place it in the designated pick-up spot prior to the driver’s arrival window.

4. Care of Toys, Wear & Tear, and Damage

We expect toys to be played with and enjoyed!

  • Fair Wear & Tear: Normal, minor cosmetic wear resulting from reasonable, everyday play (e.g., light scuffs, minor paint fading) is fully expected and will not incur any fee.

  • Damaged or Lost Items: If a toy is returned broken beyond functional play, severely stained, missing essential major components, or lost entirely, we reserve the right to charge a reasonable repair or replacement fee to your nominated payment method.

  • Notification: Please notify us as soon as possible if an item becomes damaged or missing during your subscription period so we can arrange a replacement.

5. Hygiene & Parent Inspection

  • Sanitization: All toys undergo a thorough multi-step cleaning and sanitization process using child-safe, non-toxic products before being dispatched.

  • Parental Inspection: Upon opening your Playthings container, you agree to inspect the toys prior to handing them to your child. If you discover a damaged, broken, or unsafe item, you must remove it from play immediately and contact us at support@playthings.au so we can replace it.

  • Age Appropriateness: You are responsible for supervising play and ensuring toys are used in accordance with manufacturer age recommendations.

6. Accounts

When you create an account on our Site, you agree to:

  1. Maintain the security and confidentiality of your account credentials.

  2. Provide accurate, complete, and up-to-date account and delivery details.

  3. Promptly update your information if your address or contact information changes.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or unlawful behavior.

7. Intellectual Property

All content published and made available on our Site—including images, copy, logos, graphics, and website architecture—is the property of Playthings Pty Ltd and its creators, and is protected by Australian copyright and trademark laws.

8. Payments

  • Payment Methods: We accept major credit cards, debit cards, and approved digital payment gateways.

  • Authorisation: By providing payment details, you authorise Playthings to charge all applicable subscription fees, renewal fees, and damaged/lost item fees incurred under your account.

  • Failed Payments: If a recurring billing charge fails, we may re-attempt payment and reserve the right to pause delivery swaps or collect rented items until the balance is cleared.

9. Consumer Protection Law (Australian Consumer Law)

Where the Australian Consumer Law (ACL) under Schedule 2 of the Competition and Consumer Act 2010 (Cth) applies and cannot be excluded, these Terms will not limit your statutory legal rights and remedies under that legislation.

If there is a conflict between these Terms and mandatory consumer protections, the statutory provisions of the ACL will prevail.

10. Limitation of Liability

To the maximum extent permitted by law, Playthings Pty Ltd and its directors, officers, agents, and employees will not be liable for any indirect, incidental, or consequential losses arising out of your use of the Site or the rental and use of our toys.

11. Indemnity

Except where prohibited by law, by using this Site and service you agree to indemnify and hold harmless Playthings Pty Ltd and its directors, officers, agents, and employees from any claims, liabilities, damages, and legal costs arising from your violation of these Terms or misuse of our rented goods.

12. Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any legal disputes will be subject to the jurisdiction of the courts of New South Wales.

13. Severability & Changes

  • Severability: If any provision of these Terms is deemed invalid or unenforceable under law, that provision will be severed, and all remaining provisions will remain in full force.

  • Changes: We reserve the right to update these Terms from time to time. We will notify users of material changes via email or by posting a notice on our Site.
